Terms of Use

This is the agreement between you and LucidLabs for using InstaFact. The most important part is section 4: a verdict is research assistance, not a ruling, and it can be wrong.

1. Accepting these terms

InstaFact is operated by LucidLabs, a company registered in India (“we”, “us”, “our”).

By downloading, opening or using the InstaFact app or this website, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Who may use InstaFact

You must be at least 16 years old to use InstaFact. If you are under the age of majority where you live, you may only use the service with the involvement of a parent or guardian, who accepts these terms on your behalf. You must not be barred from using the service under the laws that apply to you.

3. Your account

You sign in with your phone number and a one-time password. You are responsible for keeping access to that phone number secure, and for everything done through your account. Tell us promptly at connect@instafact.co if you believe someone else is using it.

One person, one account. Do not sell, share or transfer your account, and do not create accounts by automated means.

4. What a verdict is — and is not

InstaFact takes a short-form video link, extracts the claim it makes, compares that claim against published sources, and returns a verdict, a confidence score, an explanation and a list of references.

Verdicts are generated with the help of automated systems, including large language models, and are not reviewed by a human before you see them. That has consequences you need to understand:

• A verdict can be wrong, incomplete, or out of date.
• The system can misidentify the claim a video is actually making, particularly where the video is sarcastic, ambiguous or relies on visual context.
• Cited sources can be misread or misattributed, and a source can itself be wrong.
• A confidence score expresses how well the retrieved evidence agreed. It is not a probability that the verdict is correct.

A verdict is an expression of our assessment of publicly available evidence at a point in time. It is not a statement that any person has lied or acted dishonestly. If you believe a verdict is wrong, our Content & Corrections Policy explains how to have it reviewed.

5. Acceptable use

You agree not to:

• use InstaFact for anything unlawful, or to harass, defame, threaten or endanger anyone;
• present a verdict as something other than what it is, or alter a verdict, score or source list and pass it off as ours;
• submit links to content that is illegal where you are, including child sexual abuse material or content that incites violence;
• scrape, crawl, bulk-download or otherwise extract data from the service by automated means;
• reverse engineer, decompile or attempt to derive our source code, except where that right cannot lawfully be excluded;
• probe, scan or test the security of the service, or try to bypass rate limits, authentication or access controls;
• resell, sublicense or commercially exploit the service or its output without our written permission;
• use the service to build a competing product, or to train a machine-learning model on its output;
• interfere with the service's operation or place an unreasonable load on it.

6. Content you submit

You keep ownership of what you submit — the links, your follow-up questions, your feedback. You grant us a worldwide, non-exclusive, royalty-free licence to use, store, reproduce and process that content for as long as we need to in order to operate, maintain and improve InstaFact.

Fact checks may be shown in the public Explore feed. When that happens, the verdict and the link appear without your name or any identifier connecting the check to you.

You confirm that you are allowed to submit what you submit, and that doing so does not breach anyone else's rights or any platform's terms.

7. Third-party content

InstaFact analyses videos hosted on Instagram, YouTube and similar platforms, and cites sources published by others. We do not own, control or endorse that content, and we are not responsible for it. Those platforms and publishers have their own terms, which you remain subject to.

Our use of third-party material is for the purpose of reporting, comment, criticism and research. If you hold rights in material we have referenced and you object to its use, write to connect@instafact.co.

8. Intellectual property

InstaFact, its name, logo, design, software and the arrangement of its content belong to LucidLabs and are protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial purposes, subject to these terms.

You may share an individual verdict — including by screenshot or link — for personal, non-commercial purposes, provided you do not alter it and you do not remove the attribution or the confidence score.

9. Availability and changes

We aim to keep InstaFact available but we do not guarantee uptime. We may change, suspend or discontinue any part of the service, and we may impose limits on how many checks an account can run. Where a change materially reduces what you get, we will give reasonable notice if we can.

10. Disclaimers

To the fullest extent the law allows, InstaFact is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We do not warrant that the service will be uninterrupted, secure or error-free, that verdicts will be accurate or complete, or that defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these terms affects your non-excludable statutory rights as a consumer.

11. Limitation of liability

To the fullest extent the law allows, LucidLabs and its directors, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or connected with your use of InstaFact — whether the claim is in contract, tort, negligence or otherwise, and whether or not we were told such loss was possible.

In particular, and without limiting the above, we are not liable for any decision you make or refrain from making in reliance on a verdict.

Where liability cannot lawfully be excluded, our total aggregate liability arising out of or connected with these terms is limited to the greater of (a) the amount you paid us for the service in the twelve months before the claim arose, and (b) INR 5,000.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify and hold harmless LucidLabs and its directors, employees and agents against any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the service, or your infringement of anyone else's rights.

13. Suspension and termination

You may stop using InstaFact at any time and ask us to delete your account through our account deletion page. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we discontinue the service. Where it is reasonable to do so, we will tell you why.

Sections 6, 8, 10, 11, 12 and 14 survive termination.

14. Governing law and disputes

These terms are governed by the laws of India, without regard to conflict-of-laws rules. The courts at Noida, Uttar Pradesh have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court.

Before starting proceedings, please contact us at connect@instafact.co so we can try to resolve the matter. If you are a consumer in the EU or UK, this clause does not deprive you of the protection of your local mandatory laws or your right to bring proceedings where you live.

15. General

• Whole agreement. These terms, with the Privacy Policy and the Content & Corrections Policy, are the entire agreement between us on this subject.
• Severability. If any provision is held unenforceable, the rest continues in force.
• No waiver. If we do not enforce a right, we do not give it up.
• Assignment. You may not assign these terms without our consent. We may assign them to a successor of our business.
• Changes. We may amend these terms. The “last updated” date shows the current version, and material changes will be notified in the app before taking effect. Continuing to use InstaFact after that means you accept them.
• App store terms. If you installed InstaFact from Google Play or the Apple App Store, that store's terms also apply. Apple is not a party to this agreement and has no obligation to provide support for the app.
